SUBJECT: Submission of our petition requesting the change of identity and other relevant information and documents in accordance with the provisions of Law No. 6284 on the Protection of the Family and Prevention of Violence Against Women and Law No. 5726 on Witness Protection.
OUR EXPLANATIONS
1-) Our client and the other party were married on …./…/…. Since the establishment of the marriage, the other party has subjected our client to ill-treatment in a manner unbecoming of a marriage, and has inflicted physical, psychological, and spiritual violence. 1) Our client eloped and married the other party, and out of respect for the institution of marriage and to maintain the marital union, she never considered divorce despite having children together. However, the other party’s relentless violence resulted in our client being placed in a women’s shelter.
2) Shortly after our client was placed in the shelter, the other party was convicted of the crime of … and entered prison on …/…/… and will be released on …/…/…. Our client’s safety will be jeopardized after her release. Because even after entering prison, the other party has been tracking our client through intermediaries and trying to reach her.
3) 3) Article 4 of Law No. 6284 stipulates that “If there is a life-threatening danger to the protected person and it is understood that other measures will not be sufficient to prevent this danger, and based on the informed consent of the person concerned, their identity and other relevant information and documents may be changed in accordance with the provisions of Law No. 5726 on Witness Protection.” In accordance with this regulation, and stating that our client has given their explicit consent, it has become necessary to request, through this petition, the change of their identity information and the notification of this change to all official institutions.
