In other words, it refers to a group of people affected by social security reforms that affect the retirement age and conditions in Turkey. these people, who started working before 1999 but were negatively affected in terms of retirement age and number of bonus days due to the amendment of the social security law made in 1999, are popularly known as “EYT” li Dec. The regulation on Social Security has entered into our lives with the amendment made on September 8, 1999 to the abrogated Social Insurance Law No. 506. Employees who completed the insurance period and premium day before September 8, 1999 could retire. There was also no age requirement. With the amendment made to the Social Insurance Law, an age requirement was added next to these two criteria. In this way, the retirement age has changed with the amendment made to the Social Insurance Law in force in 1999.
Before the amendment of the Social Insurance and Universal Health Insurance Law No. 5510, which replaced the Social Insurance Law No. 506, the insurance period of 20 years for women and 25 years for men was among the pension Decrees if the premium requirement specified in the law was met.
With the Unemployment Insurance Law No. 4447 adopted on September 8, 1999, the retirement age for women became 58 and for men this age became 60.
in 2008, the retirement age was increased to 65 with the Law No. 5510 for people who started working as an insured for the first time. In other words, with the change made in 2008, people whose insurance premiums have expired can retire if they wait until the age of 65 to retire.
This problem of those who have reached retirement age and are waiting for the insurance period despite completing their premium days has been solved with the EYT Law published in the Official Gazette dated 03/03/2023. The issue of Those who are Stuck in Retirement Age (EYT) has been a problem that has been on the agenda of Turkey for a long time and is waiting to be solved. After intensive efforts to eliminate the problem, the Law on Social Insurance and General Health Insurance, which includes regulations related to EYT, and the Law on Amendments to the Decree Law No. 375, entered into force through publication in the Official Gazette on 03.03.2023. Now, people who entered insurance before 1999 will be able to retire regardless of age requirement. There are 2.25 million citizens who have completed the premium and insurance period after the entry into force of the EYT law. One million and six hundred thousand of these citizens submitted their applications in March 2023. Now they are waiting to receive their retirement pension.
In general, in order for a person to retire from the old age insurance branch (except in exceptional cases), as a rule, he must fulfill the “duration of insurance”, the “number of premium days” and the “age requirement” together. With the new regulation, the victimization that has been going on for 20 years has been eliminated and EYT residents have gained the right to retire. However, those who have retired within the scope of EYT and whose pension is incorrectly connected may request correction by applying to the Provincial Directorates of Social Security with a written petition. While the pension binding operations are continuing within the scope of Those who have reached Retirement Age (EYT), there are about 200 thousand files that have not yet been completed. Many of those who are connected to the salary think that a wrong calculation has been made. For this reason, if you think that the wrong EYT salary has been linked, you can object to the institution with a petition and request a recalculation. The legal regulation on the Retirement Age (EYT) has been published in the Official Gazette. About 2 million EYT residents applied to the directorates of the Social Security Institution and requested a pension. While applications are mainly made here via e-government, there have also been a large number of EYT people who have filled out forms in person.
