Enforcement proceedings consist of initiating proceedings with enforcement offices and formally pursuing these proceedings to collect a debt. Enforcement proceedings can be conducted by a lawyer, or the creditor can personally initiate this process.

 

Enforcement proceedings are proceedings initiated by the creditor through the enforcement offices, using state power and authority, if the debtor fails to pay their debt for any reason. Enforcement is divided into three types: judgment enforcement, non-judgment enforcement, and enforcement based on bills of exchange. A court order is required to initiate judgment enforcement proceedings. In other words, it is possible to initiate judgment enforcement proceedings based on a court order. Non-judgment enforcement proceedings, on the other hand, are initiated to collect money and collateral receivables without the need for a court order. The eviction of a leased property can also be requested through the enforcement office through a non-judgment enforcement.

 

While the subject matter of judgment-based enforcement proceedings involves not only monetary but also performance obligations, the subject matter of non-judgmental enforcement proceedings consists of monetary and collateral. Initiating enforcement proceedings based on bills of exchange is distinct from general enforcement procedures. Bills of exchange are negotiable instruments and are defined by law as restricted. Bills of exchange are bills of exchange, promissory notes, and checks. If the underlying receivable is not one of these three negotiable instruments, it will not be possible to pursue enforcement proceedings specific to bills of exchange.
