
Mandatory Elements of the Petition
In civil courts, lawsuits are filed by filing a petition. According to Code of Civil Procedure No. 6100, there are certain mandatory elements that must be included in the petition to file a lawsuit. These mandatory elements are regulated in Article 119 of Code of Civil Procedure No. 6100. According to the aforementioned article:

ARTICLE 119- (1) The petition shall contain the following:
a) The name of the court.
b) The names, surnames, and addresses of the plaintiff and the defendant.
c) The plaintiff’s Turkish Republic identity number.
ç) The names, surnames, and addresses of the parties’ legal representatives and the plaintiff’s attorney, if any.
d) In cases concerning the subject matter of the lawsuit and property rights, the value of the subject matter.
e) A clear summary of all the facts underlying the plaintiff’s claim, listed in sequential order.
f) What evidence will be used to prove each alleged fact.
g) The legal grounds relied upon.
ğ) The result of the request in a clear manner.
h) The signature of the plaintiff, their legal representative, or their attorney, if any.
(2) If any of the matters other than those specified in subparagraphs (a), (d), (e), (f), and (g) of the first paragraph are incomplete, the judge will grant the plaintiff a definitive period of one week to rectify the deficiency. If the deficiency is not rectified within this period, the lawsuit will be deemed not filed.
