EXPLANATIONS
The client debtor has made a request for attachment as of the date …, which is stated above. In addition, the vehicle with the licence plate number … registered in the name of the client debtor is also pledged within the scope of the file and has an arrest.
Pursuant to Article 111/a added to the EBL by Law No. 7343, the debtor may request that he/she be authorised to sell the seized property outside the tender process in order to sell it at its value. It is stipulated that the principles regarding the implementation will be determined by the Regulation on the Authorisation of Sale to the Debtor Pursuant to the Execution and Bankruptcy Law dated 28.05.2022. Thus, Article 111/a of the Execution and Bankruptcy Law No. 2004 authorises the debtor to sell voluntarily.
In this respect, we request the authorisation of voluntary sale for the sale of the vehicle in question by the debtor client on the grounds of procedural economy, on the grounds that it will facilitate the debtors to pay their debts and minimise the sales costs.
