SUBJECT : This is our petition containing our declarations for simple trial procedure.
EXPLANATIONS :
1-) In accordance with the interim decision of your court dated …/…/…. regarding the simple trial procedure, our statements on the merits that we submitted within the period given to us by the file examination report notified to us are as follows.
2-) As we have clearly stated in our petition for criminal complaint, our client has been subjected to sexual harassment by the defendant. The incident is more serious as the defendant is a family friend and neighbour of our client. Our client approached the defendant with the closeness and trust of a brother and was subjected to the defendant’s action.
3-) The defendant’s defence counsel tried to deny the sexual harassment offence in his petition dated …/…/…. However, it is out of the question for our client to create or fabricate this situation in her own mind. When she returned home in the shock and fear of the incident, the incident occurred when the family members she lived with were suspicious of her behaviour and went on her and tried to get words from her mouth, so to speak.
4-) Due to the incident, our client’s psychology has also deteriorated considerably and she has become hesitant to go out on the street alone. This situation will be revealed more clearly with the forensic medicine institution report to be obtained.
5-) As a result of this incident, the defendant continued to act as if nothing had happened and continued to enter and exit the client’s house on the pretext of something and on the basis of being a neighbour and family friend, and our client became afraid every time she saw him and became unable to leave her room.
In his defence on the merits, the defendant’s defence made a defence that “our client did not have any intention”. However, it is not possible for the offence of sexual harassment to be committed without the will and intention of the defendant.
CONCLUSION AND REQUEST : For the reasons we have tried to explain above, since the material and moral elements of the offence have occurred, we request and demand by proxy that the defendant be sentenced for the offence attributed to him. …/…/…
