
WHICH OFFENCES WILL BENEFIT FROM AMNESTY
In the execution of the sentence by applying the probation measure, 4/5 of the time required to be spent in penal institutions for conditional release must be spent in prison. The convict can benefit from probation for a maximum of three years.
Female convicts with children in the 0-6 age group, those who cannot maintain their lives alone due to severe illness, disability and old age, must spend 3/5 of the time they must spend in penal institutions for conditional release in prison. They can benefit from probation for a maximum of four years (The state of severe illness, disability or old age must be documented by a report obtained from the ATK or issued by the medical boards of full-fledged hospitals determined by the Ministry of Justice and approved by the ATK).
Important: For the crimes committed until 30.03.2020, the probation period has been increased from 1 year to 3 years, except for exceptional crimes.
Exception offences
- Offences of intentional killing (TCK 81, 82, 83)
- Intentional wounding and aggravated wounding offences committed against a superior, subordinate, spouse or sibling or a person who is unable to defend himself/herself in terms of physical or mental health
- The offence of aggravated wounding (Article 87, paragraph two, subparagraph d)
- Torture offence (TCK 94, 95)
- Cruelty offence (TCK 96)
- Offences against sexual inviolability (TCK 102-105)
- Drug offences (TCK 188)
- Offences against private life and private sphere of life (TCK 132-138)
- Offences against the security of the state (TCK 302-339)
- Terrorism offences (Law No. 3713)
Note: The 3-year period is also applied to well-behaved convicts in closed prison.
For crimes committed until 30.03.2020, the probation period. Was increased from 2 years to 4 years for female convicts. With children aged 0-6 years and convicts. Who have completed the age of 70, except for exceptional crimes.
