CASE : Cancellation of Inheritance Certificate
SUBJECT: What we have to say against the lawsuit.
EXPLANATIONS :1-The events described in the lawsuit petition are not true. We object. Namely
2-The date of ……., ……., which we have previously received from ……. by the plaintiff, ……. Main and ……. Decision numbered certificate of inheritance is objected.
3-The objections are completely baseless. The plaintiff claims that he is the child of the deceased from an extramarital relationship and therefore he is also the heir.
4-The certificate of inheritance is issued by examining the population records of the deceased. The court has also done this. If the plaintiff has a claim, he/she should express his/her claims that he/she is the child of the deceased in another case, prove his/her case, and change the population record according to this new decision. Only then can he file a lawsuit for the cancellation of the existing certificate of inheritance. However, the plaintiff does not have a case in this way. The certificate of inheritance is valid until the contrary is proved.
5- We request that the plaintiff’s baseless claims and the lawsuit be dismissed.
CONCLUSION OF THE REQUEST : For the reasons explained, we request that the plaintiff’s lawsuit be dismissed, that all kinds of trial fees and expenses be charged to the other party, and that the opposing party’s attorney fee be awarded on our behalf as an attorney in accordance with the 164/last paragraph of the Law No. 1136 on Attorneys amended by Law No. 4667.
