CRIME : Defamation, Slander and other offences that your prosecutor’s office will rule ex officio.
EXPLANATIONS :
The suspect worked at the client’s workplace for a period of time. During this period, he borrowed some money from the client but did not pay these borrowed money. Enforcement proceedings were initiated against the suspect for these. Monies sent by the client through his bank account. There is a hostility between the client and the suspect due to this reason.
In the correspondence between …….. numbered phone in the use of the suspect and …………. numbered phone in the use of the client between the dates ../../…. and ../../…., the suspect has insulted the client in the records presented in the annex.
Although the client warned the suspect not to write to him and not to disturb him, the suspect continued to write persistently and with the sole intention of disturbing the client. Most of the insults addressed to the client by the suspect have been deleted from whatsapp records. The client has had the chance to take screen photos of only a certain part of these insults.
Due to these actions carried out by the suspect. The offence of insult regulated in Article 125 of the Turkish Penal Code and the offence of disturbing. The peace and tranquility of persons regulated in Article 123 of the Turkish Penal Code have been committed.
Article 125 of the TPC stipulates that “A person who imputes. A concrete act or fact to a person. (…)[45] that may offend his/her honour. Honour and dignity or who attacks the honour, honour and dignity of a person. By swearing shall be sentenced to imprisonment from three months. To two years or to a judicial fine. In order to punish the insult in the absence of the victim. The act must be committed in the presence of at least three people. (2) If the act is committed through an audio. Written or video message addressed to the victim. The penalty specified in the paragraph above shall be imposed.” Therefore, insults against my client are considered an offence under the Turkish Penal Code.
When all these issues are carefully examined. We request that a public lawsuit be filed for the punishment of the suspect since his actions constitute an offence according. To Article 125 of the Turkish Penal Code.
