SUBJECT OF REQUEST: It consists of our request that the gifts be returned due to the Decease of the engagement between the parties.
INSTRUCTIONS
Plaintiff A…B… and defendant C…D…, ……….. By renting the engagement hall located at Beşevler Çankaya Ankara, ../../…. They were engaged in an engagement ceremony, which was also attended by the close circle of the parties in their history. During the engagement ceremony, a gift worth TL 000.00 was given to the defendant by the plaintiff’s client and his family. Photo and video recordings of the engagement ceremony in question are October in the appendix. (October-1)
As the date of the marriage approaches, the attitude of the defendant and his family towards the client and his family has begun to change. The financial burden of the items taken for use in the marriage union was tried to be placed on the plaintiff’s client and his family; tensions Dec between the parties. The defendant’s attitude towards his client has changed.
Mutual friends of the parties who are aware of the defendant’s attitude to the client../…/…. During the conversation, the defendant suddenly rose up and the plaintiff began to insult the client and declared that he had broken off the engagement. Friends of the parties also testified to this incident, and the witness list is presented in the October to our petition. (October-2)
October the defendant broke off the engagement, the gifts given to the defendant at the engagement were requested back by the client (message records are presented in appendix October-3), the defendant did not return the gifts. In addition to the damage that the client suffered when the engagement was broken up, he was also financially harmed by the defendant. The invoices for the gifts given by the client and his family to the defendant at the engagement are presented in October annex to this petition. (October-4)
Since the defendant broke off the engagement without a justifiable reason and did not return the gifts given to him due to the engagement despite the request, the need to open this case has arisen.
LEGAL REASONS: TMK, HMK, Law on Advocacy and other relevant legislation
EVIDENCE : Photo and video recordings of the engagement ceremony, invoices for gifts given to the defendant due to the engagement, message records of witnesses and other all delail
CONCLUSION AND CLAIM: For all the reasons explained above; provided that our rights to claim the excess are reserved;
1- Acceptance of Our Case,
2-Return of gifts worth TL 000.00 that were given to the defendant who broke the engagement without a rightful reason to the plaintiff client in the same way as the gifts that were given due to the engagement,
3-If it is not possible to return the gifts in kind, the case value of TL 000.00 will be taken from the defendant and given to the plaintiff,
4-We request by proxy that the decision to leave the costs of the trial and the power of attorney to the defendant be made. 11.02.2022
