Appeal Against Arrest

Arrest is a precautionary measure, which can be applied by the court at the stage of investigation and prosecution of the suspect. However, in order for the court to make a decision on the arrest of the suspect, the following conditions must be established in the Criminal Procedure Code.

These circumstances are the presence of concrete facts that arouse suspicion of escape or concealment of the suspect or accused, the actions of the suspect aimed at obscuring the evidence or putting pressure on the victim. But in order for an arrest decision to be made, there must be certain conditions, as well as material conditions. These conditions are the absence of a ban on arrest, the absence of obstacles to arrest, the absence of a certificate of guarantee for the accused, the fact that the arrest is commensurate with the crime committed on the accused, the decision of a judge or court. If the arrest request, which has been left to the discretion of the judge or the court at the request of the prosecutor’s office, is found appropriate and approved by the judge or the court, there is a way to appeal this decision. Within 7 days following the day of the decision to arrest, the suspect may appeal this decision. The arrest decision made against the suspect is made to the court that made this decision.

In a situation where a detained suspect will appeal against detention and demand release, the most important thing is to avoid filing an appeal against the arrest of the victim, who lacks legal technique and is taken from the Internet environment. The petitions on the Internet or the petitions prepared for the wishful thinking are the victims and are insufficient to achieve the desired result. The nature, nature and evidentiary status of the crime committed against the detainee requires a good understanding of the situation assessment with technical legal knowledge, preparing an effective arrest appeal petition and achieving the desired result, undoubtedly receiving the support of a good criminal lawyer.
