
The Social Security Institution (SGK) Health Board determines the degree of disability, and disability pensions are granted based on this decision. Upon the request of an insured person, and after reviewing reports and supporting medical information properly prepared by the health boards of hospitals authorized by the SGK, if the SGK Health Board determines that the insured person has lost at least 60% of their working capacity, they are deemed disabled, granted disability retirement, and receive a pension.
It is observed that the disability degree reported by the health board of the referred hospital is generally reduced by the SGK Health Board. Therefore, if your disability degree has been reduced and you have not been granted disability retirement, you can exercise your right to appeal the SGK Health Board’s report. If your appeal is successful and your disability degree is not changed, and you are not granted retirement, you can file a lawsuit with the Labor Court. Based on the report you obtain from the hospital designated by the court, the court will determine your degree of disability. If the court determines that you have suffered a loss of working capacity of 60% or more, you can be granted disability retirement.
