
Execution and Bankruptcy Offenses – Failure to Deliver Requested Property, Failure to Be Present During Bookkeeping, Failure to Comply with Orders of the Bankruptcy Administration
Article 337/2: “Those who violate the provisions of Articles 162, 209, and 216 shall be subject to the same penalty upon a warrant issued by the bankruptcy administration. If the obligations specified in these articles are fulfilled, the penalty for execution offenses shall be dropped.”
As stated above, the first paragraph of the article was annulled by a decision of the Constitutional Court; however, since there is no annulment decision regarding the second paragraph, execution offenses remain in effect. As clearly stated in the article, the penalty will be dropped if the specified obligations are fulfilled.
