SUBJECT: Our request for eviction due to the tenant’s default.

 

EXPLANATIONS: 1- The defendant tenant is residing in the property owned by me, located at …. address, as a tenant pursuant to a lease agreement dated …/…/… and is currently paying a monthly rent of … TL.

 

2- Although the lease agreement between us stipulated that the rent payments would be deposited into the account at …… Bank …… Branch between … and … of each month, the defendant failed to deposit the rent for the month of … of … year into the relevant account on the dates specified in the agreement. Therefore, we are requesting payment of the overdue rent from …. A notice was sent to the defendant via a notary public on …/…/… date, informing them that if they did not pay the rent within 30 days of the date of notification, they would be considered in default according to the Code of Obligations and an eviction lawsuit would be filed against them. Despite this, the defendant has not paid the said rent.

 

3- Therefore, due to the tenant’s default in failing to pay the rent of … TL, it has become necessary to file this eviction lawsuit.

 

LEGAL GROUNDS: Code of Obligations, Code of Civil Procedure, and other relevant legislation.

CONCLUSION AND REQUEST: For the reasons explained above, I respectfully request and demand that the court order the eviction of the defendant from the rented property, the collection of the unpaid rent of … TL, and the defendant to bear the court  costs.
