EXPLANATIONS
1-) The … Public Prosecutor’s Office, regarding the numerous files under …/… and …/…, decided to separate the files containing legal and factual connections among the preparatory documents, to close the registration of the …/… numbered document, and to proceed with the smuggling case under the …/… numbered document. While the violation decision dated …/…/… and numbered …/… was served on …/…/…, we cannot agree with this decision, and it is also not in accordance with the law.
2) Because, in order for a decision to separate the files to be made, it is necessary for one of the most suspicious individuals in the files to be divided, meaning that at least one person in each of the files planned for consolidation must be a “suspect”; however, in file number …/…, our client is a suspect, but has no role in the other file, and his testimony was only requested in that file, and this fact was overlooked. The differences in circumstances were compiled through an examination of the court files.
3) The information we have explained… The decision of the Chief Public Prosecutor’s Office dated …/…/… and numbered …/… regarding the individuals involved in the separation has resulted in the request to return the file to the relevant Chief Public Prosecutor’s Office for this purpose.
