What is a Protective Order?

Under Law No. 6284 on the Protection of the Family and Prevention of Violence Against Women, there are two types of protective orders. The first is a protective order, and the second is a preventive order. Protective orders are also divided into two categories based on the authorities that issue them. The first is issued by the local administrative authority (governor or district governor), and the second by the family court (civil courts in places where there is no family court). In administrative protective orders, the primary authority rests with the local administrative authority. However, in cases where delay would be detrimental, a law enforcement officer can also issue a protective order.

EXPLANATIONS:
1-) Our client …. ….. and the opposing party, the spouse complained against, have been married since ….. date, and their marriage records are in … Province, … District, … Neighborhood, … Volume No., … Family Sequence No. and … Sequence No. (APPENDIX-1)
The parties have two children from this marriage: … born on …/…/… and … born on …/…/…. 2-) The defendant spouse is not fulfilling the obligations imposed on him by the marriage union, and when our client reminds him of this, he resorts to violence. The defendant comes home late at night intoxicated and beats our client and children. This matter will be clarified by the statements of our witnesses, whose names and addresses are included in the witness list we have submitted as an annex to our petition (ANNEX-2), and whom we request to be heard before your court. On the other hand, the relevant doctor’s reports are included in the annex. (ANNEX-3)
3-) For these reasons, it has become necessary to make this application to your Office in accordance with Law No. 6284, in order to take the necessary measures against the spouse complained of and for the protection of our client and our joint children. LEGAL GROUNDS

CONCLUSION AND REQUEST
