EXPLANATIONS :
The administrative fine issued against my client is against the law. Namely;
A traffic fine report dated 00.00.0000, dated 00.00.0000, dated 00.00.0000, dated 00.00.0000, with a total value of 000 TL, was issued and notified to my client on 00.00.0000, on the grounds that the private car registered in the name of my client, registered under the registration plate 00000000000, committed the offence of ‘not complying with the red light rule’ in accordance with the provision of Article 47/1 B of the Highways Traffic Law.
This report was issued in my absence and is unfair and devoid of legal basis. There is no signature of the driver of the vehicle in the said penalty report, and the fact that this action is carried out in absentia is contrary to the principles of clarity and legality of administrative action. Because it is not clear by whom the vehicle was used. When the penalty report is evaluated in terms of the individuality of the penalties, it constitutes a violation of the law. As can be understood from the relevant penalty report, there is no signature of the client on the report or an annotation stating that he refrained from signing. In addition, there is no legal basis stating that the vehicle was managed by the client on the event and date subject to the penalty report. There is also no evidence that the red light violation was committed. Considering the possibility that the vehicle could have passed the yellow light on the specified day and time, the fine is unjustified.
As a result, it has become necessary to apply to your honourable court for the cancellation of this fine and report due to the fact that the said fine has been imposed unjustly without any proof and evidence (for example, mobese recording), leaving it solely and solely to the initiative of the officer who wrote the fine.
