What Is An Appeal Against Administrative Court Decisions

After the legal remedy of appeal, some decisions of the regional administrative court may be appealed.

The final decisions of the case departments of the Council of State and the decisions of the regional administrative courts on the cases listed below may be appealed to the Council of State within thirty days of the notification of the decision, even if there are provisions to the contrary in other laws:

Annulment lawsuits filed against regulatory acts, full judgment lawsuits with a subject matter exceeding 100 thousand TL and lawsuits filed against administrative acts,

Annulment lawsuits filed against actions resulting in dismissal from a certain profession, public office or student status,

Annulment actions filed against transactions that prevent the performance of a certain commercial activity indefinitely or for thirty days or longer,

Annulment lawsuits filed against the appointments, transfers and dismissals made by joint decree, and the appointments, transfers and dismissals of the heads of departments and higher level public officials,

Lawsuits arising from zoning plans and parceling procedures,

Decisions of the Central Commission for the Protection of Natural Assets and the High Council for the Protection of Cultural Assets upon objection and lawsuits arising from the implementation of the Bosphorus Law No. 2960,

Lawsuits filed against the transactions related to the implementation of the legislation on mining, quarries, forestry, geothermal resources and natural mineral waters,

Lawsuits concerning nationwide examinations administered for the purpose of education or the practice of a profession or art, or for entry into public service,

Lawsuits arising from the implementation of the legislation on the granting of operating permits for coastal facilities such as ports, cruise ports, marinas, marinas, piers, docks, fuel oil and liquefied petroleum gas pipelines,

Lawsuits arising from the implementation of the Law No. 3996 on the Construction of Certain Investments and Services within the framework of the Build-Operate-Transfer Model and the Law No. 4283 on the Establishment and Operation of Electric Energy Generation Facilities with the Build-Operate-Operate Model and the Regulation of Energy Sales,

Lawsuits arising from the implementation of the Law No. 3218 on Free Zones,

Lawsuits arising from the implementation of the Law No. 5403 on Soil Conservation and Land Use.

Lawsuits filed against the decisions taken by the regulatory and supervisory boards in relation to the market or sector they are in charge of.
