SUBJECT OF LAWSUIT : Request for eviction due to unlawful occupation.
FACTS : 1- Tenant K lives as a tenant in accordance with the lease agreement dated …./…./….. in accordance with the lease agreement dated …./…./….. in the apartment located at the address ……… in …….. province, ……. district, ……. district and the ownership of which belongs to my client, the Lessor … and still pays a monthly rent of …….. TL monthly rent.
2- The lease agreement between the tenant ….. and my client, the Lessor … contains the provision “the tenant cannot sublease the leased property to another person under any circumstances and cannot transfer the lease agreement” in the article … of the section titled special conditions.
3- However, despite the aforementioned provision, the Lessee …. rented the apartment at the above address to the defendant Third (name and surname). This situation is contrary to both the provisions of the ………. contract and the defendant is in a situation of fuzuli occupation in the lease in question.
4- In this respect, it has become necessary to open this eviction case for the evacuation of the leased property by terminating the occupation of the defendant unfair sub-tenant ….., which occupies the apartment belonging to my client.
