Arraignment

Arraignment is the questioning and listening of the person who is a party to the case by the judge in matters against him. Istijvap is of Arabic origin, derived from the word answer and means “questioning” as a word. Legally, the legal side of a case is that a person is questioned about a certain or several cases.

Article 169 of the Code of Civil Procedure regulates that the judge can decide on the resignation of each of the parties spontaneously or on request. The subject of the application procedure is about the cases that form the basis of the case and the issues related to these cases. It is a request procedure for the court to interrogate a person who is a party to the case spontaneously or on request on a matter that is against him or her and is the basis of the case. However, not every case in which the parties are questioned by the judge during the hearing is a case of resignation. In order to implement Isticvap, certain conditions must be created.
