SUBJECT OF THE CASE : A request to return. What was given from the testamentary creditor (……. TL)
INCIDENTS : 1- Plaintiff clients, muris ………….they are the heirs of . The defendant is the person appointed as the testamentary creditor by the will of the muris.
2- According to the will of the Muris, the defendant. Was paid the will he should have received on time. However, later an unknown debt of the inheritor emerged and was paid by the claimants who were the heirs. With this payment, the heirs’ reserved shares were violated and the will payee’s receivables. Had to be subjected to criticism.
For this reason, it has been mandatory to open this lawsuit in order for the two thousand lira portion of the money paid to the testamentary creditor to be criticized.
LEGAL REASONS :
EVIDENCE : Probate certificate, debt paying documents. Witness statement and all kinds of evidence.
CONCLUSION AND REQUEST: I wish that with the acceptance of the case according to the reasons presented. Above and the evidence shown, it will be decided to take the TL portion of the will made to the defendant (……), and the costs and attorney fees will be charged to the defendant.
