First of all, it should be noted that the surviving spouse inherits together with whichever degree (caste) has the right of inheritance. If there are no heirs in the first two grades, and in the third grade, if the heads of the grades and their children died before the heir, the spouse will be the sole heir and will prevent the state from inheriting. This sole heirship of the spouse means her legal heirship. Otherwise, if there are appointed heirs, the spouse will be heir together with them.
The Spouse’s Inheritance Together with the First Degree: When the spouse is an heir together with the first degree heirs, the share of inheritance in the estate to be taken as the basis for the division of property in inheritance is 1/4
Spouse’s Being an Inheritor Together with the Second Degree: When the spouse is an heir together with the heirs who have the right of inheritance in the second degree, he/she receives 1/2 of the estate as inheritance share
Inheritance of the spouse together with the heads of the third degree and their children: If the spouse inherits together with the heads of the third caste and their children, the share of inheritance will be 3/4 of the estate
Cases where the spouse has the right of inheritance alone: If there are no heirs in the first and second degree, and if the heads of the third degree and their children are not alive, the spouse will be the sole heir. In other words, in the third degree, the spouse can only inherit together with the grandparents and uncles, aunts and uncles. If there are none of them, the spouse will be the sole legal heir. In other words, the inheritance in the third degree cannot be passed on to their children. The existence of the spouse prevents the heirship of their descendants.
