FACTS : 1- The plaintiff client has been married to his defendant wife for … years and they have accepted the property partnership regime in their marriage.
2- The client’s father passed away and the plaintiff became the heir. However, since his father was a bankrupt merchant, his estate is insolvent.
3- My client wants to reject the inheritance because the estate is insolvent, but the defendant spouse does not allow this.
Therefore, it has become necessary to make this request.
LEGAL GROUNDS :
EVIDENCE : Population record, property partnership agreement, document stating that the inheritance is insolvent and all kinds of legal evidence.
