The case for changing the name is regulated in Article 27 of the Turkish Civil Code. According to this article, the change of name can only be requested from the judge on the basis of justifiable reasons. The right to change a person’s name is a legal exercise of the right to a person’s existence, which is strictly dependent on the person. Due to the fact that names are quite important for people, it has been made possible to request the change of name from the court if there is a justified reason. If a person changes his name, his personal status will not change. Also, the case for changing the name does not just mean changing the existing name. Therefore, if there is a justified reason, people can request from the court that a second name be added to the existing name or they can also request that their second name be deleted.
What Are The Justifiable Reasons For The Name Change Case
The justifiable reasons in the name change case are not listed in the law and are relative. Because names represent people, justifiable reasons can also change depending on the event, and personal reasons can also be considered as justifiable reasons. To give a few examples of justifiable reasons, we need,
- The fact that the person’s name is funny, ridiculous,
- Belonging to a criminal who is poorly known or known in society,
- Mentioning his name with a bad event,
- Having a name that does not comply with the general moral code,
- Pronunciation of a person’s name is difficult
- It reminds of a person’s trauma,
- Professional grounds,
- Artistic grounds,
- Inability of people to feel like they belong to the name,
- Recognition of persons by a name other than the written name from their identity,
- Political, immoral names that will hurt people,
- Changing religion can be cited as an example.
Absence of a Justifiable Reason in a Name Change Case
If there is no justified reason for changing the person’s name, the claimant’s request to change the name may be appealed through a representative sent by the Population Directorate. Because the defendant in the name change cases is the Population Directorate of the counterparty. Therefore, as a counterparty, the Population Directorate sends a representative to the hearings.
