FACTS : 1- While the plaintiff was married to the client ………………, the regime of participation in acquired property was applied between them, and as a result of the liquidation made upon the death of his wife, the plaintiff was entitled to the participation receivable from his deceased wife.
2- However, the estate of the deceased. Spouse is not sufficient to meet the participation receivable. Since the defendant also benefited from the assets of the deceased spouse due to gratuitous acquisition. It was necessary to apply to him for the missing part.
