The person who loses or falsifies the cheque for any reason can apply to the Commercial Courts of First Instance in the place of residence or payment of the bearer and cancel the cheque with a petition stating that this cheque is lost.
Who Can File a Cheque Cancellation Lawsuit?
In order to file this lawsuit, it is necessary to be an authorised bearer. To define the authorised bearer, it is the person who holds the cheque in bearer cheque, the person whose name is on the registered cheque, or the person who submits the most recent assignment agreement.
