WHAT IS THE WAIVER OF THE COMPLAINT?
Abandonment of a complaint refers to the refusal of the victim, the complainant, the participant or the victim who uses the right to complain in a criminal investigation or prosecution to exercise the right to complain. The right to dismiss a complaint can be exercised by the person himself or herself and by his or her deputy, who has special authority in the power of attorney.
IS THERE A PERIOD FOR DISMISSING THE COMPLAINT?
Although the law provides for a period of 6 months in order to exercise the right to complain, no time has been given for waiving the complaint. The dismissal of the complaint can be made at the investigation stage until the investigation stage is over, that is, until the decision is made by the prosecutor, and at the prosecution stage until the decision made by the court is finalized.
HOW TO OPT OUT OF A COMPLAINT?
Complaints to the competent public prosecutor in the investigation phase of abandonment, or criminal prosecution and the trial court engaged in criminal court with a petition or oral statement made by passing minutes.
