
When it is decided that there is no room for prosecution, the suspect and the person who has been harmed by the crime are notified of the decision of non-prosecution in question. The person who has been harmed by the crime has the right to appeal the decision within 15 days after the decision has been notified to him. If the offender does not exercise his right to appeal within the time limit, the decision that there is no room for prosecution becomes final.
However, if the offender uses his right of appeal within 15 days and is rejected by the magistrate as a result of the appeal, the decision of non-prosecution will be finalized. In other words, the decision that there is no place for prosecution becomes final if the person who has been harmed by the crime has not exercised his right to appeal or if he has exercised his right to appeal and the appeal has been rejected.
